Terms and Conditions for Treehouse Point

Welcome to Treehouse Point! These Terms and Conditions outline the rules and regulations for the use of Treehouse Point's website, located at book.treehousepoint.com/search, and for booking reservations at our bed and breakfast. By accessing this website and making a reservation, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or make a reservation.

1. Definitions

- "Company," "we," "us," and "our" refer to Treehouse Point.

- "Client," "you," and "your" refer to the person accessing and using this website and making a reservation.

- "Content" refers to all materials, information, and intellectual property on this website.

2. Intellectual Property

All content on this website is owned by Treehouse Point and/or its licensors and is protected by applicable copyright and trademark laws. You may not reproduce, modify, distribute, or create derivative works from any part of this website without our prior written consent.

3. User Conduct

When using our website, you agree to:

- Provide accurate and current information about yourself

- Not use the website for any unlawful or unauthorized purpose

- Not post any inappropriate, offensive, or defamatory comments or content

- Not attempt to gain unauthorized access to any part of the website

4. Reservation and Booking

By making a reservation through our website, you agree to provide accurate and current information about yourself and your party. You also agree to pay all fees associated with your reservation, including any taxes or additional charges. A 50% deposit will be charged upon booking, regardless of payment method. All bookings will automatically be charged the remaining balance 14 days prior to the arrival date. Should your final payment be declined, we will contact you via email and/or phone. Failure to respond to our notification more than 7 days prior to your stay will result in the cancellation of your reservation, as well as the related charges, noted in the Cancellation Policy.

5. Cancellation Policy

As part of booking your reservation with us, you agree to our cancellation policy. We want to ensure that our cancellation terms are transparent and easy to understand. Please take a moment to review the details below:

- A $100 cancellation fee applies to all cancellations, regardless of the time of cancellation.

- If you cancel your reservation three weeks (21 days) or more prior to your scheduled stay, you will receive a full refund, minus the $100 cancellation fee.

- If you cancel your reservation between 14 and 20 days prior to your scheduled stay, you will receive a 50% refund, minus the $100 cancellation fee.

- If you cancel within 14 days of your scheduled stay, unfortunately, no refund will be provided.

We highly recommend reviewing your travel plans carefully before making a reservation to minimize any potential financial impact.

6. Property Rules and Restrictions

- ABSOLUTELY NO LIVE FLAME, GLITTER OR BALLOONS PERMITTED ANYWHERE ON PROPERTY. NO VAPING OR SMOKING PERMITTED INSIDE ANY OVERNIGHT ACCOMMODATION. SMOKING AND VAPING IS ONLY PERMITTED WITHIN DESIGNATED AREA. NO IRONS, CURLING IRONS OR HEATED HAIR TOOLS ARE ALLOWED INSIDE THE TREEHOUSES. FAILURE TO ADHERE TO THIS POLICY WILL RESULT IN AN AUTOMATIC $500 FEE.

- During periods where a 2-night stay is required, the 2-night reservation is valid only for the party making the reservation; the 2 nights may not be "split/shared" with another party. Reservations in violation of this clause are subject to cancellation without refund by Treehouse Point.

- Based on guest feedback and in order to maintain a comfortable experience for all of our overnight guests with whom you will be sharing Treehouse Point during your stay, there is a 3-room booking limit for the same dates of a reservation. Any reservation-grouping for the same dates in excess of this 3-room limit will have all reservations canceled by Treehouse Point and will carry all associated cancellation fees.

- You certify that all persons in your reservation are 16 years of age or older. Arrival with underage persons will result in cancellation of your reservation without refund. Minors must be accompanied by an adult (21 or older) throughout the duration of the stay.

- Our rooms accommodate 2 people in a shared bed, with the exception of Upper Pond (4 people, 2 in upper bunks; 2 in shared bed). NO ADDITIONAL PERSONS ARE ALLOWED IN ANY TREEHOUSES OR OVERNIGHT ACCOMMODATION PER THE FIRE CODE.

- No non-overnight guests are allowed to "visit" the property without prior verbal/written consent from Treehouse Point staff.

- Having professional photography taken during an overnight stay is subject to advance arrangement and additional fees. Please contact Treehouse Point to make arrangements. Failure to make advance arrangements for photography during an overnight stay will result in a non-discounted, automatic charge of related fees to the credit card on file for your reservation.

- You acknowledge that our location is both an overnight retreat and an event center and that there may be other events held onsite during your reservation.

- You acknowledge that we do not accept pets, including dogs. We follow ADA guidelines re: Service Animals, and the ADA clearly states that Emotional Support Animals do not qualify. You agree to notify us when making your reservation should you have a qualified-under-ADA-guidelines Service Animal.

7. Damages and Liability

You acknowledge that you are liable for any damage howsoever caused (whether by deliberate, negligent, or reckless act) to the room(s), bed and breakfast's premises or property caused by you or any person in your party during your stay. Should this damage come to light after your departure, we reserve the right and you hereby authorize us to charge your credit or debit card for any damage incurred, including and without limitation for all property damage, missing or damaged items, smoking fee, cleaning fee, guest compensation, etc. We will make every effort to rectify any damage internally prior to contracting specialists to make the repairs, and therefore will make every effort to keep any costs that you would incur to a minimum. Guest rooms found with waste strewn around, in complete disorder, and/or "trashed" will be subject to maintenance deep cleaning fee, administration fee and/or third party fees.

8. Limitation of Liability

To the fullest extent permitted by law, Treehouse Point shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of this website or any content or services provided through this website. You agree to hold harmless Raging River Events LLC, DBA Treehouse Point, the owners, and/or any employee of the aforementioned, for any accident or injury that occurs while a guest at Treehouse Point. You acknowledge that Treehouse Point may not be held negligent. Treehouse Point is not responsible for the loss or damage to property of any person who uses the facility or adjacent parking areas during time on property. Treehouse Point is not responsible for acts of nature, including power outages, which may affect accommodation, and is not responsible for remuneration of guest due to such circumstances beyond our control.

9. Indemnification

You agree to indemnify and hold Treehouse Point harmless from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of this website or your violation of these Terms and Conditions.

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Washington, without giving effect to any principles of conflicts of law.

By using our website and making a reservation, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, including the Cancellation Policy and Property Rules and Restrictions. We reserve the right to update or modify these terms at any time without prior notice.
